Subject: 2007 Legislative Changes Which Will Effect Registration Procedures

As a result of the passage of several Senate and House Bills, the following changes/amendments will become effective July 1, 2007:
Senate Bill 124 amended Section 320.0863, Florida Statutes, to provide for “Custom Vehicles.” These vehicles are 25 years old or older with a model year after 1948 or manufactured to resemble such a vehicle and have been altered from the manufacturer’s original design or have a body constructed from nonoriginal material. In addition, this statute allows for the development and design of a “Custom Vehicle” license plate.
Senate Bill 136 amended Section 320.08058 (49), Florida Statutes, to redistribute the funds from the sale of Live the Dream license plates. After the initial $60,000 is collected for the Dream Foundation, Inc., 25% of the sales will be split equally among sickle cell organizations and the continuing promotion and marketing of the license plate and concept.
Bill 1134 amended Section 479.07,
Senate Bill 1630 amended Section 320.08058 (29), Florida Statutes, to redistribute the funds from the sale of United States Marine Corps license plates. After the first $50,000 is collected annually and distributed to the Marine Corps Scholarship Foundation, Inc., thirty-five percent shall be deposited in the State Homes for Veterans Trust Fund and sixty-five percent shall be distributed to the Marine Corps Scholarship Foundation, Inc.
Senate Bill 2052 amended Section 320.08058(28), Florida Statutes to distribute the proceeds of the annual use fee to the Florida Wildflower Foundation, Inc.
House Bill 517 amended Section 324.021(8), Florida Statutes, to exempt the owner, registrant, or operator of a motor vehicle from providing proof of financial responsibility if he/she is a member of the United States Armed Forces and is called to or on active duty outside this state or the United States. They are also exempt if the owner of the vehicle is the dependent spouse of the active duty member and is residing with the active duty member out of state, and the vehicle is maintained out of state.
House Bill 615 added Section 320.02(16) (e), Florida Statutes, to include language permitting a voluntary contribution of $1 per applicant to be distributed to the Children’s Hearing Help Fund.
House Bill 7173 amended or added to the following Florida Statutes:
Section 320.08056(4) (s), Florida Statutes was amended to increase the annual use of the Sea Turtle license plate to $23.
Section 320.08058(1), (5), and (18), Florida Statutes were amended to distribute the funds of the annual use fee differently.
As a result of the passage of Senate Bill 1900, the following changes/amendments will become effective October 1, 2007:
Section 320.0894, Florida Statutes, was added directing the Department to develop and issue a “Gold Star” license plate honoring the family of service members who have been killed while serving in the Armed Forces of the United States.
Section 320.08056(4) (hhh)-(lll), Florida Statutes were added to include five new license plates. They are:
§ Florida NASCAR $25
§ Corrections Foundation $25
§ Protect Florida Springs $25
§ Trees Are Cool $25
§ Support Our Troops $25
Section 320.08056(12), Florida Statutes was added to allow the applicant for a specialty license plate the option to instruct the department to provide his/her name, address, and renewal date to the sponsoring organization.
Section 320.08058(14), Florida Statutes was amended to allow up to 25 percent of the funds from the sale of the Florida Agriculture license plate to be used for promotion, marketing, and administrative costs directly associated with the license plate and Florida agriculture in the classroom programs.
Section 320.08058(28), Florida Statutes was amended to have the fees distributed to the Florida Wildflower Foundation, Inc., and to allow 15 percent of the proceeds from the sale of such plates to be used by the foundation for administrative costs and marketing costs.

created the Florida NASCAR license plate.

Section 320.08058(63), Florida Statutes created Protect Florida Springs license plate. The annual use fee shall be distributed to the Wildlife Foundation of Florida, Inc.
Section 320.08058(64), Florida Statutes
created the Trees Are Cool license plate.

As a result of the passage of House Bill 275, the following changes/amendments will become effective January 1, 2008:
Section 320.01(19), Florida Statutes was amended to show the definition of “Registration Period” and “Extended Registration Period.”
