Questions About The Driving Record


What is on the 3 year and 7 year driver records?

  • Driver license/identification card issuances, exams passed, driver education.

  • Guilty convictions for traffic violations, within 3 or 7 years of the conviction date.

  • Crash entries, within 3 or 7 years of the crash date, when a traffic citation was issued as a direct result of the accident.

  • All open suspensions, revocations, cancellations, disqualifications of the driving privilege.

  • Suspensions, revocations, cancellations, and disqualifications cleared within 3 or 7 years of the request date, unless retention is met and entry has been purged. Also D-6 suspensions once cleared are transferred to correspondence entries and would not appear on 3 or 7-year records. However, if a conviction for driving while license cancelled, revoked or suspended is on the record, D-6 suspensions will not transfer to correspondence. Also, on records of CDL drivers D-6s will not transfer to correspondence.

  • Correspondence indicating license issued by another state.

What is on the complete driver record?

  • Driver license/identification card issuances, exams passed, driver education.

  • All convictions for traffic violations appearing on the driver record.

  • Crash entries, within 10 years of crash date, when a traffic citation was issued as a direct result of the accident.

  • All open or closed suspensions, revocations, cancellations, disqualifications appearing on the driver history. Also, D-6 suspensions once cleared are transferred to correspondence entries and would not appear on complete records. However, if a conviction for driving while license cancelled, revoked or suspended is on the record, D-6 suspensions will not transfer to correspondence. Also, on records of CDL drivers D-6s will not transfer to correspondence.

  • All entries of traffic violations with disposition of adjudication withheld.

  • Correspondence indicating license issued by another state.

  • Correspondence indicating adjudication withheld (when not eligible or made election but did not complete).

What is adjudication withheld?

  • A person may elect to complete a driver improvement school in lieu of receiving points.

  • A person who elected to enter a plea of nolo contendere and provide proof of compliance.

  • Adjudication withheld by the court – the judge or traffic magistrate withheld adjudication

How many times can I elect to complete driver improvement school in lieu of receiving points?

  • Effective October 1, 2008…Florida Statute 318.14(9), provides that a person may make no more than five traffic school elections within ten years and once in twelve months.

  • Florida commercial driver license holders are not eligible to elect completion of a driver improvement school to avoid assessment of points for traffic tickets, regardless of whether the violation was committed in a commercial motor vehicle.

Why is the record blocked?

  • The Driver Privacy Protection Act (DPPA) keeps your personal information private by limiting who has access to the information. DPPA is designed to limit public access to your social security number, driver license or identification card number, name, and address. Personal information protected by DPPA does not include “driving violations, and driver’s status.”

  • The department automatically blocks personal information on your motor vehicle and driver license records.

  • Florida Statute 119, allows for certain individuals in sworn or high risk positions to have their information blocked from those who are exempt from the privacy act.

How long do entries stay on the record?

  • Citations – 10 years

  • Citations (adjudication withheld clerk of court) – 10 years Citations (adjudication withheld judge) – indefinite

  • Suspensions and Revocations – 7 to 11 years

  • Alcohol related entries – 75 years

  • Serious commercial driver license violations – 55 years

Why is the original issue date on my record showing my last issuance date when I have had my license or identification card for much longer?

  • If the license or identification card has been expired more than 15 months then the record purges (drops off) from the system and therefore when the next license or identification card is issued then the original issue date will show as the current issuance.

  • To correct the original issue date the department will need proof of an earlier issuance so that the date can be changed.


What are the different types of actions on the driving record?

  • Revocation – the termination of a driving privilege.

  • Suspension – the temporary withdrawal of a driving privilege.

  • Administrative Suspension – the departmental withdrawal of the driving privilege.

  • Cancellation – the act of declaring a driving privilege void and terminated.

  • Disqualification – the withdrawal of the privilege to have a commercial drivers license.

  • Withdrawal – applies to commercial drivers only. Term used in place of suspension or revocation. Indicates the commercial driver had his or her privilege withdrawn in another state.

What are the different types of dispositions on the record?

  • Guilty – convicted of a ticket or having admitted guilt.

  • Estreature – when a person has posted bond to guarantee an appearance in court, then does not appear.

  • Forfeiture – when the person who posted bond doesn’t show up for court and forfeits the right to contest the ticket.

  • Adjudicated delinquent – a person found to have committed an offense that, if committed by an adult, would be a criminal offense.
